This article provides the terms of use for stubborntoad.com. We recommend all visitors read these terms and conditions before starting to use or purchase any item from our site. By using our site, you indicate that you agree to both our Terms and Conditions and Privacy Policy. If you do not agree to either of these articles, please refrain from using our site. A contract between Stubborn Toad will exist until an order has been accepted, (in case of commission, created and paid for in full), processed, dispatched, and received.

Stubborntoad.com is operated by Stubborn Toad. This is the trading name of Stubborn Toad Ltd, of 11 Bray Road, Reading, RG30 3JD, we are a private limited company. Company number:13879888. For these Terms and Conditions, “we”, “us, “stubborn toad”, and “our” all refer to Stubborn Toad Ltd. “You” refers to all users of this website or whose name appears on an order, quotation request, or commission receipt from our website or any other channel operated by us.

To the fullest extent permitted by law, Stubborn Toad is providing this site and its contents on an "as is" basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose. Stubborn Toad does not represent or warrant that the information accessible on our site is accurate, current, or complete. Price and availability information is subject to change without notice. Except as specifically stated on this site, to the fullest extent permitted by law, neither Stubborn Toad nor any of its affiliates, directors, employees, or other representatives will be liable for damages arising out of or in connection with the use of this site or the information, content, materials or products included on this site. Fulfillment

Due to the nature of our business, stock availability cannot be guaranteed. If your goods are in stock the order will be shipped in order to reach you within 5 working days in the United Kingdom or 14 working days for select countries outside of the UK area. Stubborn Toad Ltd may decide which countries to which it ships at its own discretion. This may be due to changing shipping costs. Stubborn Toad Ltd will notify its customers and users of new shipping destinations or removed destinations by means of our website and our social media pages. In addition, only UK orders will be accepted for skateboards and canvases, Stubborn Toad is open to consider shipping outside of the UK. For this, please contact us by email, phone or social media.

Once you have placed an order with Stubborn Toad an email will be sent to you confirming your order details. A second e-mail will be sent once your order has been dispatched. It is important that you give us a valid email address so you can receive these emails.

Stubborn Toad reserves the right to accept or reject any order at our absolute discretion. Whilst we try to ensure that such prices are accurate, Stubborn Toad also reserves the right to correct the prices if we discover an error. In this event, you will be entitled to cancel your order or re-confirm it at the correct price.

In addition to the United Kingdom and the Channel Islands, Stubborn Toad Ltd can deliver to Jersey, Guernsey, Ireland, Spain, France, Germany, Belgium, Portugal, Luxemburg, Sweden, Norway, Denmark, Italy, Poland, and the USA.

Cancellation of orders, given the nature of electronic commerce, is not possible online, if you choose to cancel an order before it is dispatched please contact us on 07737 258416. If there is an issue with your goods once you receive them, contact us immediately and we can inform you of your entitlements. If the issue falls under our commissions the product will need to be sent back to Stubborn Toad for assessment before we can issue any refunds or replacements. Please note, the risk of damage to, or loss of, any goods will pass to you when the goods are delivered to you. 

Commission Orders

A pre-paid deposit is required for any commission which is non-refundable. This amount will be accounted for in the total commission cost once the piece is complete.

If an order is cancelled at any point during production, the deposit will be kept by Stubborn Toad in order to cover the costs of material.

If we are unable to contact you over a period of 14 days, the order will be cancelled and you will be asked to create a new order and pay a second deposit.

Payment

We can currently accept payments from Paypal, Visa, Mastercard, and American Express. For your security, all payments on our site are processed through either Paypal or Stripe. Stripe ensures all data provided by you is encrypted and stored across various machines to achieve the highest level of security.

Returns Policy

If a product is received and is faulty or is not as described. Stubborn Toad Ltd guarantees the quality of all of our products before shipping and all will have to be inspected and agreed by Stubborn Toad as faulty. In certain circumstances, it may be necessary to send the item to the manufacturer before we can accept them as faulty. You will need to pay postage for all returns, though if the item is faulty we will compensate you for your shipping costs. If the item is found to be indeed faulty, we will offer a refund, exchange, or replacement. Our commission products such as skateboards and canvases are custom made to each order and as a result, we cannot offer a replacement. As allowed by law, we are not obliged to pay for shipping back to our office. We recommend you keep a note of your order number in case you need to contact us with a product or return. We cannot accept a return of a product with no faults or issues. In addition, snapped or cracked boards usually occur when your foot is in the wrong position when landing a trick or grab. Unfortunately, if this happens, Stubborn Toad cannot replace your broken board or a board with pressure cracks.

Where specified, certain products may vary slightly due to the creation process, for example, dip-dye, or tie-dye on apparel. Stubborn Toad may not be able to guarantee the exact pattern of the product.

Sticker Pack offer (pair of stickers, ten pack)

Stubborn Toad can offer refunds on the WHOLE pack but if only a part of the order is returned, we will only provide the reduced cost of each sticker/print in the refund.

Undelivered Parcels

Customers must contact us about undelivered/missing parcels within 90 days of placing their order, all orders will be assumed delivered correctly unless contact is made within this timeframe.

Governing Law

These terms and conditions shall be construed in accordance with English law and the courts of England OR the jurisdiction in which you are resident or domiciled (at Stubborn Toad election) shall have jurisdiction to resolve any disputes between you and Stubborn Toad, without regard to any choice of law provisions or private international law. You hereby consent to the exclusive jurisdiction and venue of the Royal Courts of Justice, Strand, London, UK, for any and all disputes relating to the Terms of Service, use of this web site or any Linked site in the event that Stubborn Toad have elected England as the jurisdiction.

Entire Agreement

The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Stubborn Toad Ltd. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of Stubborn Toad Ltd. None of the above affects you statutory rights under English Law.

Cancelling an order under the distance selling regulations

In accordance with the Distance Selling Regulations, you have 7 working days from the day after you receive the goods to cancel your order if you find the product is faulty, is not as described, or does not function how is expected to.

We will accept confirmation of order cancellation via email if your order is submitted and yet to be dispatched. If your order has been dispatched, you must write a letter or send an email to us to request cancellation. (Our address can be found on the contact us page.) The letter can be sent within the parcel of goods being returned. You must include your order number, name, and billing address. Deposits for commission orders will be kept by stubborn toad and are non-refundable.

We will cancel and fully refund the order including original postage costs as long as the whole order is returned. You will be refunded within 30 days. We cannot accept cancellation of an order if goods have been made specific for a customer and have been dispatched. For example a commission of traditional art or a skateboard deck.

We strongly recommend recorded or signed-for delivery so the parcel is insured and trackable. You must take reasonable care of the goods while in your care and they will be returned at the customer’s cost. All goods must be returned within 14 days of the requested cancellation.

Goods returned with postage labels attached to the products e.g. shoe boxes, without original labels or suitably packaged for transit may incur a compensation fee for the lost value. If you do not ensure reasonable care and goods are returned damaged, we may claim against you for breach of this statutory right.

If you fail to return the goods following your cancellation request we may send a courier to you at your expense of £6.95 to collect the goods. This cost will be deducted from your total refund. If you still fail to return goods we can charge you the direct cost of recovery and may claim against you for breach of your statutory duty.

Discount codes and promotions

Only one discount code can be applied to an order.

We reserve the right to cancel any order, or withdraw/extend any promotions at our discretion.

All offers are time-bound, ending at midnight on date specified unless highlighted otherwise.

Cannot be used in conjunction with any other offer.

Minimum spends apply.

Unless specified, free delivery promotions are for standard 3-5 working day delivery.

Stubborn Toad Ltd reserves the right to cancel an order where the number of products exceeds the limit of one per order, any orders with a higher quantity can be cancelled at our discretion.

In the event you win a competition held by Stubborn Toad, you will have 4 weeks to claim your prize. Where available you will be contacted via email, phone, and social media.

If the prize is not claimed after 4 weeks, the competition will be re-drawn and a second winner will be chosen.

For any Limited Edition Runs

• Limit one Order per delivery address and per email. As stock will be limited. Multiple entries will result in all those entries being cancelled.
